In my view of human life on the Planet Earth, I see a countless number of areas screaming for a higher level of understanding that quite possibly our little minds are not yet capable of conceiving that really and truly need improving in order for us to survive before we cross the line of no-return. The Planet's Eco System is a far more pressing issue that the vast majority of its' Inhabitants tend to ignore. We talk about Red & Blue States during election cycles as a grim reminder of the ideological differences between Conservatives & Liberals, illustrated mainly in more predominant topics such as fiscal responsibility, tax subsides versus increased spending for social & infrastructure programs, proLife versus Freedom of Choice. Noticeably absent at least for many Americans that pay taxes, consume products, serve our Country during wartime & peace and raise families, are those Citizens who practice Alternative Lifestyle other than your typical Male/Female partnering that we are raised to believe is God's intent and anything that deviates from this intent is spawn from evil and/or is misguided. On Nov. 4th, the Country made several decisions on what direction we want at least the next four years to move towards. One of those decisions was confined solely on the California Proposition's Ballot. This blog entry is to direct your attention to Proposition 8, which was intended to reverse the State's position on Same Sex Marriage. Of course, Nov.4th is long gone and the Proponents of Prop.8 tout what they collectively refer to as a victory. Below is the history of Proposition 8 which this optimistic soul firmly believes will shall be revived, for & against, again & again until the Country begins to prioritizes what issues are truly pressing that must be addressed which will determine if in fact we will even have people on this Planet to argue whether they should have the Right to marry. Background In March 2000, California voters passed Proposition 22 to specify in state law that only marriage between a man and a woman is valid or recognized in California. In May 2008, the California Supreme Court ruled that the statute enacted by Proposition 22 and other statutes that limit marriage to a relationship between a man and a woman violated the equal protection clause of the California Constitution. It also held that individuals of the same sex have the right to marry under the California Constitution. As a result of the ruling, marriage between individuals of the same sex is currently valid or recognized in the State. This Link Illustrates the Arguments For & Against Proposition 8 The results are as follows: Yes -5,769,939Percentage -52.3% No - 5,266,794Percentage -47.7% Although this proposition reverses the State's Supreme Court's decision that agreed to allow person's of Same-Sex to marry, by no means should this thwart efforts to reintroduce the measure. My personal feeling is, determine how & why the Voters upheld Prop 22. Understand its' argument that convinced the Voters that same-sex marriage is fiscally beneficial for the State and construct arguments to the contrary. However this battle should be waged solely in the Supreme Court. Currently our Federal Government is ducking this topic and relinquishing its' authority by allowing the States to decide it's own position. If Citizens who wish to live in a Country that is truly a Democracy, then this issue must be fought in the Highest Court in the Land away from State Supreme Courts. State Supreme Courts are nothing more or less than a side show relegated in rendering decisions to mask an indecisive Country. However it can be done although, I don't think tacking decisions of this nature is best served during General Election Cycles. Candidates who are dependent on support rarely take a stand in such issues regardless of how they feel about such topics. We have selected our next President of the United States. In two years, many Senators and/or Congress Seats will be coming up for re-election. The current President is considered Lame Duck therefore I think this would be the exact moment a qualified team of passionate Attorneys would get the most traction by filing to reconsider to the Federal Supreme Court. |
