Because price gouging only offers higher returns if there are actually people there to buy into it, and I can't think of many who would consider buying digital games for retail prices. Sadly, EA seems to survive explicitly because they somehow have an audience of zombies that will actually defend them and buy into it, and for the life of me I can't understand how they manage that in spite of the mountain of bad publicity they've amassed. I've bought a couple EA Sports titles, not every year mind you, but I've kinda stopped doing that as well. The last not sports EA game I bought was MIrror's Edge maybe?

(Basically over the next year or two the licenses expire with the major NCAA Conferences, taking away teams, which means fans are less likely to buy and boom goes the the dynamite)

Of course, knowing EA there are a few catches - you can only refund within 24 hours of first playing the game, and within 7 days of downloading it otherwise - but one can certaintly hope this quickly becomes a precedent to follow. Especially considering that even Steam doesn't allow refunds yet.

Otherwise, I'm sure everyone will abuse this and try to be an entitled fuckwad, then they'll probably retract it.
