Joel Silver, who brought forth the Speed Racer live-action a few years back (and admits that it essentially "failed" his expectations) is intending for it to be distributed by Warner Bros. which means a possible theatre release, as opposed to Cartoon Network's rather lackluster straight-to-TV live action movies, Race Against Time and Alien Swarm. Silver also wants to prepare an entirely different cast than that of the previous live-action movies. Ultimately, they hope to have this movie spark off a franchise of its own, which would most likely be split off from the animation timeline, as the sequel to Ultimate Alien, Ben 10: Omniverse, is set to start airing sometime in September this year.

Also of note is that Albert Torres, one of the previous writers for the Akira live action (which still sits squarely in development hell/limbo) will be writing for this movie.

I don't how much better a theatrical release will make a live action adaptation of Ben 10, I just don't see it working. Even if they used better CG, actors who could act and a plot that didn't sound like it was written by someone from Fanfictions.net, it's still difficult to imagine.

Why not make a theatrical animated movie instead? Did you see how awesome the Heroes Unite crossover was with Generator Rex? Make something like that, but like, 90 minutes long and with a good budget behind it and it'll really sell.
