Seeing how he's probably the one who wont have sequels after this, it makes even more sense. Unless they make another avengers movie. Also, surprise villain. If that wasn't the case, then Marvel would be making the Spider-Man movies and then we'd get better quality stuff that's consistent with the rest of the universe.

If the actor for the new Spider-Man appears in the Avengers, it's part of a separate contract for a cameo, Sony can't keep Marvel Studios from writing in the Spider-Man character as they don't technically own the character Spider-Man. They just own the rights to make more movies about him.
