http://www.detroitnews.com/apps/pbcs.dll/a.../602220320/1006 From the Detroit News today: Wednesday, February 22, 2006 Wayne Briefs Livonia [size=7]Lawsuit seeks halt to school closings[/size] An attorney filed a lawsuit Tuesday on behalf of parents seeking a halt to the Legacy Initiative, a controversial plan adopted by the Livonia Public Schools board that will close seven schools and reconfigure grade levels this fall. Attorney Mayer Morganroth filed the complaint at the Wayne County Circuit Court seeking an injunction, claiming the Dec. 5 vote by the school board to adopt the plan was "arbitrary and capricious." I merged these two topics everyone (Lawsuit Filed, and First hearing). Things were getting cluttered and confusing at the top of the board. Don't worry if things seem a bit muddled hear. First hearing date is set for March 10th at 9:00am at the Coleman A Young Building in Detroit. Judge John A Murphy was appointed to the case. My understanding from last Thursday's meeting with Mr. Morganroth is that we will know about the TRO within a couple of days. |

From this point on the district cannot pretend to not know or to assume that this is going to blow over. This is only the beginning. Remember the TRO could be denied but that is OK. We can file for an injunction. At any rate, the district has been notified and if they move forward they are doing so at their own risk. This is good news. But, please don't be disheartened if it doesn't go through... this is ok. Just a step in the process! |

The complaint calls for the court to declare the school board's approval of the plan null and void, because its action was "arbitrary, capricious, improper and unlawful." The group wants the court to prevent the district from closing schools and altering staff levels, school start or end times, current grade arrangements among schools and the busing schedule. It also wants to prevent the district from distributing information about the transition, or selling, leasing or modifying district property. |

The judge assigned to the case is Honorable John A Murphy. Hearing is set for March 10th. TRO is still pending. |
